Welcome to Topp Photography (“we,” “us,” “our”). By booking a session, purchasing prints, or using our website topp.photography, you agree to these Terms & Conditions. Please read them carefully before using our services.

1. Services

Topp Photography provides professional photography services, including portrait sessions, drone services, event coverage, digital photo delivery, and print sales.
All services are subject to availability and may require a signed digital photography contract.

2. Booking and Payment

  • A retainer fee is required to reserve your date and time.
  • Retainers are non-refundable but may be applied toward rescheduled sessions at our discretion.
  • Full payment is due by the date specified in your contract or invoice.
  • Payments are processed securely through Square or other approved methods.

Failure to complete payment may result in cancellation of your session or withholding of images.

3. Cancellations and Rescheduling

  • Clients may reschedule once with at least 48 hours’ notice, subject to availability.
  • Cancellations made less than 48 hours before the session forfeit the retainer.
  • Topp Photography reserves the right to reschedule due to illness, unsafe conditions, or unforeseen circumstances.

In the unlikely event we must cancel and cannot reschedule, all payments (including retainers) will be refunded in full.

4. Image Rights and Usage

  • Topp Photography retains copyright and ownership of all images created.
  • Clients receive personal-use rights to print, share, and display the photos.
  • Images may not be altered, sold, or used commercially without written consent.

We reserve the right to use selected images for portfolio, website, and marketing purposes,
unless the client requests otherwise in writing before the session.

5. Delivery of Images

  • Digital images are delivered via a secure online gallery or digital download link.
  • Typical turnaround time is 2–4 weeks for standard sessions, or as stated in your contract.
  • Print orders are fulfilled in studio and provided within a week of order

6. Client Responsibilities

Clients are responsible for:

  • Arriving on time and prepared for their session.
  • Obtaining necessary permissions for chosen locations (if required).
  • Ensuring minors are accompanied by a parent or legal guardian.

7. Artistic Style

By booking with Topp Photography, you acknowledge familiarity with our portfolio and artistic style.
Editing, composition, and selection of final images are solely at our discretion.

We do not guarantee the inclusion of every shot taken during a session.

8. Digital Files and Archiving

We may share information with:

  • Final edited images are retained for at least six (6) months after delivery.
  • We are not responsible for storing or replacing files after that period.
  • Clients are encouraged to back up all digital files immediately upon receipt.

9. Limitation of Liability

While every effort is made to provide a safe and professional experience, Topp Photography is not liable for:

  • Loss, damage, or delay caused by technical failure, weather, or unforeseen events.
  • Accidental injury, property damage, or other incidents during sessions.

Our total liability for any claim shall not exceed the total amount paid for the service.

10. Privacy

All personal information collected is handled in accordance with our privacy policy.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

12. Updates to Terms

Topp Photography reserves the right to update or modify these Terms & Conditions at any time.
Changes will be posted on this page with an updated “Effective Date.”
